California Employee Privacy Policy
This California Employee Privacy Policy (“Notice”) explains how Fairway Independent Mortgage Corporation (referred to herein as “Fairway,” “we,” or “us”) handles Personal Information (defined below) of individuals who are California residents and (1) Fairway job applicants; (2) current or former Fairway employees, independent contractors, and/or contingent workers; and (3) dependents, beneficiaries, and emergency contacts of current and former Fairway employees, independent contractors, and contingent workers. If you provide Fairway with the Personal Information of third parties (i.e., dependents, beneficiaries, and emergency contacts) for employment or benefit purposes, you shall notify such third party of the limited purpose(s) for which you provided Fairway with their Personal Information and this Notice.
Fairway’s general Privacy Policy is available on our company website and remains effective, as applicable, in addition to this Notice. In the event of any discrepancy between this Notice and the Privacy Policy, this Notice controls.
- PERSONAL INFORMATION WE COLLECT AND USE
“Personal Information” generally means any information that identifies you as an individual and any other information we associate with it. We collect a few categories of information, from a few different sources, as outlined below. By using any of our websites or mobile applications in the United States (collectively, “Sites”), otherwise providing Personal Information to us and our approved vendors, applying for or inquiring about employment with us, accepting employment with us, and/or inquiring about or providing contractor or contingent worker services to us, you agree to this Notice.
Personal Information You May Provide
Employment Communications. We collect and use your name(s) (legal, preferred, and alias), home address(es), cell phone number(s), personal email address(es), date of birth, preferred pronouns, and photo to identify and communicate with you, alert you of important business matters and local weather concerns, provide required notices, and recognize your birthday.
Employment Eligibility. To ensure compliance with immigration laws and verify employment eligibility, we collect your immigration, citizenship, residency status, information, and documentation, including, but not limited to, Social Security card, birth certificate, drivers’ license, passport, and/or other acceptable documents to verify your identity and authorization to work in the United States to complete the United States Citizenship and Immigration Services’ Form I-9 (Employment Eligibility Verification).
Payroll, Taxes, and Reimbursement. To pay you for your work or services performed, and to withhold the proper taxes, wage withholdings, and garnishments (e.g., child support, alimony, subpoenas), we collect your Social Security number, withholding elections and allocations, and payment elections, which may include banking information, bank routing and account numbers, voided checks, and home address(es). We also use this information to reimburse you for work‑related expenses. We will also request your year-end tax document printing election.
Fitness and Wellness Programs. To provide, administer, and document employee participation in employer-sponsored fitness and wellness programs (as available from time-to-time), we may collect information about participation in those classes and programs.
Licensing. To ensure compliance with applicable licensing requirements for mortgage loan officers, attorneys, and other employees who require licensure to perform their jobs, we may collect your licensing information, including, but not limited to, licenses held, license details, licensing status, renewals, and regulatory actions taken against you; financial history information to determine any barriers to becoming licensed, such as prior foreclosures, bankruptcies, status on exclusionary/ineligibility lists, revocation of bonds, unsatisfied judgments, and delinquent court orders for child support payments; whether you have voluntarily resigned any employment positions after allegations accusing you of fraud, dishonesty, theft, wrongful taking of property, or violations of statutes, regulations, rules, or industry standards of conduct; and whether you are, or have been, involved in any financial services-related consumer-initiated arbitrations or civil litigation.
Benefits. To offer, administer, and facilitate Fairway’s benefit programs (including, but not limited to, Fairway’s medical/health, vision, dental, life insurance, disability insurance, retirement benefits, deferred compensation plans, long-term care plans, fertility benefits, and other fringe benefits and employee perks); provide benefit related notices, insurance cards, and proof of coverage; and withhold appropriate payroll deductions, we may collect your date of birth; Social Security number; address; smoking status; and family, dependent, domestic partner, and beneficiary‑related information, including, but not limited to, your family member and dependents’ identifying information, contact information, proof of domestic partner and dependent status, proof of qualifying events, and medical-related information. If negotiated as part of an employment offer, to reimburse employees for the cost of COBRA coverage through their prior employer until becoming benefits eligible with Fairway, we may collect the cost of COBRA coverage, including applicable receipts and documentation. To determine retirement benefit eligibility, we may collect information regarding any relatives who also work at Fairway.
In the Course of Employment. To maintain workplace safety and security; administer medical leaves, military leave, and other leaves and accommodations; provide workers’ compensation coverage and disability insurance; and facilitate diversity and inclusion initiatives and programs, we may collect information related to your medical and disability status, your ability to perform essential functions of the job position, documentation of workplace injuries, membership in a protected class under applicable laws, proof of military service or military orders, and workplace surveillance (e.g., video surveillance and facilities entry and exit information). In the event of a potential workplace injury or other emergency, we may collect the name and contact information for your emergency contact.
Training and Compliance. To administer conflicts of interest policies and comply with applicable laws, including licensing regulations, we may collect information related to your outside business interests, ownership, activities, and employment, your spouse/domestic partner’s outside business interests and ownership, your business licenses (e.g., insurance, securities, real estate, appraisal, notary, and other financial-related licenses), your marketing agreements and websites, and information related to your completion and performance of Fairway trainings and compliance with regulatory licensing requirements (e.g., continuing education). We may also collect your employment agreements or contracts with current or former employers to ensure you are not bound by any restrictive covenants that would limit your ability to perform your job duties for Fairway.
Travel and Expenses. To administer our travel expense policies and to reimburse you for work‑related travel and other expenses, we may collect information related to your business travel and spending history, as well as work-related expenses and credit card use.
Job Applications and Promotions. When you apply for employment or are considered for a promotion or new position, we may collect and consider your name (legal, preferred, and alias); prior names used; date of birth; Social Security number; email address; time zone; phone number; home address; preferred contact method; whether you are under the age of 18 (and if so, your parent/guardian’s email address); resume; prior employment/contractor status with Fairway (if applicable); prior employment applications submitted to Fairway (if applicable); education information; employment history and experience; referral source and relationship (if applicable); need for sponsorship of visa status; legal authority to work in the United States; skills; business ownership stake/involvement (and that of your spouse/domestic partner); other employment held; referral, consulting, or other fees you receive; whether you offer/provide continuing education courses to settlement service providers; licenses held; license information and status; client/contract management database system used, if any; marketing agreement, if any; financial history; regulatory actions; status on exclusionary/ineligibility lists; consumer report results; employment references and verifications; performance evaluation information; and all information outlined in the Licensing subsection above if you are applying for a Loan Officer position.
Personality Testing. To understand the work-related proficiencies of applicants and employees and foster a better workplace team environment, we may collect personality testing and psychometric assessment information, including, but not limited to, DISC (“Dominance, Influence, Steadiness, and Compliance”) and Predictive Index assessments.
EEO-1 and Targeted Groups Demographic Information. To comply with federal EEO-1 and applicable state reporting requirements, we may collect personal demographic information from employees, including, but not limited to, their race/ethnicity and sex/gender. To apply for the Work Opportunity Tax Credit (WOTC) federal tax credit, Fairway may collect applicant and employees’ status in a targeted group, including, but not limited to, being a qualified IV-A recipient, veteran, ex‑felon, designated community resident, vocational rehabilitation referral, summer youth employee, supplemental nutrition assistance program benefits recipient, supplemental security income recipient, long-term family assistance recipient, and long-term unemployment recipient.
Veteran Status. To recognize employees who have served in the U.S. military, provide paid time off for Veterans Day, obtain WOTC credits, and facilitate military leaves of absence, we may collect information and documentation related to employees’ military service, including military orders.
Information Collected Automatically from Your Devices
In the course of your employment, in addition to the information collected as outlined above, we may collect additional Personal Information automatically from your devices, for safety, security, performance, and productivity analysis and purposes, as follows:
When You Access Fairway Information and Systems Using Personal Devices (e.g., smartphones and tablets). Your name, username, phone number, email address, what information and systems were accessed, access date/times, and information about your device, including identification and security status information may be collected from your operating system and platform.
When You Access Fairway Information and Systems Using a Computer (e.g., Fairway‑owned desktop or laptop, personally-owned desktop, laptop, and tablets connected via VPN). Your name, username, Internal Protocol (“IP”) address, access date/times, timestamps of system and application activity, contents of communications made using company accounts (including email and instant messaging), and Internet activity (collected from your operating system and platform) may be collected. We use this information to ensure employees engage in appropriate, business‑related use of Fairway’s electronic communications systems, ensure security of Fairway’s confidential and proprietary business information, and protect the confidentiality and security of information related to Fairway’s clients.
Information Collected from Other Sources
Vendors, Suppliers, and Others Doing Business with Us. We may collect or receive your Personal Information as outlined above through our vendors, suppliers, and others doing business with us to provide employment, benefits, legal, reporting, payroll, and human resources services.
Background Check Vendor. We may collect consumer reports (i.e., background check, credit history checks, and employment verifications) from our approved consumer reporting agencies and vendors, which may include any of the Personal Information listed above to ensure you are eligible for employment and licensing purposes and comply with applicable laws and regulations.
Recruiting and Staffing Agencies. We may receive employment-related information and contact information of potential employment candidates and contingent workers so that we can communicate with them and consider them for employment opportunities or contracting/contingent worker services.
Sensitive Personal Information
“Sensitive Personal Information” includes your Social Security number; driver’s license number; federal and/or state ID card; passport number; precise geolocation; racial or ethnic origin; religious beliefs; union membership; health and genetic data; biometric data; information about your sex life or sexual orientation; account login; financial account; debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; and the contents of mail, email, and text messages when Fairway is not the intended recipient. We only collect, use, and share your Sensitive Personal Information for the purposes we include in this Notice and only as needed for your employment/services relationship with us.
- COOKIES AND SIMILAR TECHNOLOGIES
System Logs and Records. Our system logs may record certain information about visitors to our Sites, including the web request, IP address, device and mobile ad identifiers, browser information, interaction with the Sites, pages viewed, application usage, and similar information. We may collect similar information from emails you receive from us that can help us track what emails are opened and links are clicked. Additionally, any time you log into a Fairway system or account, such access will be recorded.
Cookies. We use certain cookies, pixel tags, and other technologies to understand how you use the Sites enabling us to personalize your experience. We may ask advertisers or other third-party partners to send ads or services to your devices, which may rely on cookies or similar technologies placed on our Sites.
Providing and Improving Services. We may detect the general physical location of your devices by, for example, using general GPS information collected by mobile applications and location information shared by your web browser to enhance and facilitate our services. Job applicants who wish to opt out of such collection may adjust the settings of their devices so that information about their physical location is not sent to us or third parties by (a) disabling location services within the device settings; or (b) denying certain websites or mobile applications permission to access location information by changing the relevant preferences and permissions in their mobile device or browser settings. Please note that your location may be derived from your Wi-Fi, Bluetooth, and other device settings; consult your device settings for further information.
- HOW WE SHARE PERSONAL INFORMATION
If we share your Personal Information, we will share only the necessary information and take reasonable steps to ensure anyone we share with takes prudent steps to protect your Personal Information. We may share any of the information outlined herein with third parties for a business purpose as follows:
Affiliates. We may share your Personal Information with our locations, subsidiaries, and affiliates.
Service Providers. Other companies sometimes provide certain services to us or on our behalf (e.g., payroll services, insurance/claim processing, maintenance and IT support, consumer reporting agencies, remote poster services, unemployment claims processing, human resources services, analysis/consulting, and benefits). Unless we tell you differently or as described elsewhere in this Notice, our service providers are not permitted to use or share your Personal Information except to assist us in performing business functions and offering benefits on our behalf.
Discount Insurance Vendor. We may share your Personal Information with Mylo, LLC, an outside vendor that emails discount insurance programs to our employees.
Third Parties with Whom You Direct Us to Share Your Personal Information. If you direct us to share your Personal Information with a third party, we will share only the information that is needed to complete your request.
Compliance with Legal Obligations. We may disclose Personal Information to auditors, government authorities, law enforcement, regulatory agencies, our legal counsel, third‑party litigants and their counsel, and other authorized individuals to comply with applicable laws/regulations, subpoenas, discovery requests, and other legal obligations, such as contractual requirements.
Changes in Business Structure/Ownership. Your Personal Information is considered a company asset and may be disclosed or transferred to a third-party in the event of any proposed or actual purchase, reorganization, merger, sale, lease, acquisition, joint venture, assignment, amalgamation, transfer, or any other type of acquisition, disposal, disposition, or financing of all or any portion of our business, assets, shares, or ownership interest (including through bankruptcy or similar proceedings) or our affiliates for you to continue the same or similar relationship with the third-party.
Fairway does not sell Personal Information of applicants, employees, or children or share such Personal Information with third parties for their commercial use.
- REQUIRED DISCLOSURES
In certain circumstances, we may choose or be required to provide additional or different disclosures to residents of California. Below are the disclosures that may be applicable to you:

California law requires us to inform you of the Personal Information we collect about you in a certain way – specifically, we must relate it to “legal categories” of Personal Information listed in the law. As such, we compiled the information above in a chart outlining:

- The source from which your Personal Information is collected
- The purpose for collecting and using your Personal Information for each legal category
- The business purposes for sharing your Personal Information and with whom
We have included these items in the Personal Information Privacy Chart at the end of this Notice, as well as a list of Personal Information we disclose for a business purpose.
B. Your Privacy Rights and Choices
California law requires we disclose the privacy rights you have regarding Personal Information as follows:
- Access. You may have the right to access and receive a copy of your Personal Information we collect.
- Know. You may have the right to know the categories of Personal Information collected, used, shared, and sold, including the related categories, sources, and business purposes.
- Delete. You may have the right to request we delete or erase your Personal Information if we do not have a legal or business reason to keep it. Note, however, that we may not always be able to comply with such requests for specific legal reasons, which will be communicated to you, if applicable, at the time of your request.
- Correct. You may have the right to request correction of Personal Information we have about you.
- Opt Out of Sale or Sharing. Fairway does not engage in the sale of Personal Information. You may have the right to request that we do not share or sell your Personal Information with third parties.
- Limit Use and Disclosure of Sensitive Personal Information. You may have the right to direct Fairway to limit use of your Sensitive Personal Information to only what is necessary to perform the business purposes included in this Notice or reasonably expected from us as your employer or potential employer.
- Non-Discrimination / Non-Retaliation. You may have the right not to receive discriminatory or retaliatory treatment for the exercise of any privacy rights conferred by applicable law.
- Portability. You may have the right to receive a copy of your Personal Information in a commonly used, machine-readable format so that such information can be transferred to another business.
These rights may be subject to certain limitations or exceptions under California law and the purpose for which we process Personal Information.
Where applicable and technically feasible, Fairway will accommodate your valid request to exercise your privacy rights and choices. You may also designate an authorized agent to make a request on your behalf.
C. How to Make a Request

- Other Designated Methods.We only have two designated methods for submitting your verifiable consumer request, and currently we do not accept requests via US mail. This is to protect you—and us—from fraudulent activity.
D. Handling of Your Request
- Response Timing and Format. We aim to respond to a consumer request within 45 calendar days of receipt. If we require more time, we will inform you of the reason and extension period, in writing.
- Responding to Requests. Your request will be evaluated to determine whether the requested change meets legal regulatory requirements. If we are unable to honor any part of your request, we will relay that in our response, as well as the reason(s) we cannot do so.
- Verifying Your Identity. To review your request, we first need to verify your identity to ensure you are the individual we may have collected Personal Information about or a person who has been duly authorized to make the request on your behalf. For example, if you make a request from your Fairway email account, we will not ask you to provide anything else, but if you make a request from a non-Fairway email or using another method, we will ask you to confirm your name and Social Security number. For certain requests, we may require additional information to verify your identity to protect your information.
- Appealing a Denied Request. If we deny all or part of your request, you may have a right to appeal that decision. To appeal a decision, contact us using the contact methods above and include your name, email address, physical address, the type of request made, and reason for requesting an appeal.
- Requests by Authorized Agents. You may have the right to designate an authorized agent to make a request on your behalf. Authorized agents may make a request by using the contact methods above. As permitted by California law, any request to designate an authorized agent is subject to an identification and verification process and confirmation of the authorized agent’s authority, which may include attestation under penalty of perjury. Absent documentation of a power of attorney, we will also require you to verify your own identity when designating an authorized agent. We may verify identity based on matching information you provide with information we have maintained on you in our systems, including, but not limited to, email address, mailing address, and phone number.
- DATA RETENTION
We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Notice unless a longer retention period is required or permitted for legal, auditing, or compliance purposes. Applicable record retention timeframes are outlined in Fairway’s Record Retention Policy.
- HOW WE PROTECT YOUR PERSONAL INFORMATION
With recent events and regulatory changes, our customers, business partners, and employees are increasingly asking how Fairway protects the sensitive information entrusted to us. We recognize this is a significant trust and one we do not take lightly. Information security is a complex subject, and the technical details are beyond the scope of this document. However, this Notice provides a general overview of the information security controls in place and operating at Fairway.
The Fairway Information Security Program relies on a strong industry standard as the primary framework for our control design, implementation, and operation, including physical, technical, administrative, and procedural controls. We continually invest in and enhance these controls to meet new threats and vulnerabilities. We work with several leading information security firms that assist us in the implementation, operation, and review of our security controls, including periodic assessments and testing.
Fairway uses technology to strengthen the security of its stored data, reduce potential attack points, as well as encryption to protect data when it is transmitted and when it is stored “at rest.”
Additionally, our employees and associates are provided training on the protection of borrower information and are engaged in an active, continual Information Security Awareness Program that keeps information security in focus throughout the year.
We use standard physical, technical, and administrative measures to reduce the risk of loss, misuse, unauthorized access, disclosure, and modification of Personal Information. Unfortunately, no system or network is guaranteed to be 100% secure. If you have reason to believe your interaction with us is no longer secure (for example, if you feel the security of your Personal Information with us has been compromised), please immediately notify us using the contact methods herein.
- UPDATES TO THIS NOTICE
We may periodically update this Notice. Any changes to this Notice will become effective once published on our Sites. Your continued employment, or providing of services, following any changes means you accept such revised Notice. The published version of this Notice supersedes all prior versions published or distributed and all inconsistent oral or written statements regarding your privacy rights.
